The League of Women Voters brought suit charging that the law and its exemption for those voting absentee violates Indiana's requirement that elections be "free and equal". The State of Indiana defended the suit saying Voter ID was legal, helpful in combating voter fraud and that the suit was improper in making Secretary of State Todd Rokita the defendant.
